The organic system of laws, regulations and normative documents related to food proction, processing, circulation and consumption is called food safety legal system. As early as the founding of new China, the Chinese government promulgated a series of health management requirements to ensure food safety. Since the 1980s, the Chinese government has made and revised a series of laws and regulations related to food safety. Among them, there are more than 30 kinds of laws and regulations formulated by the state, and nearly 100 kinds of laws and regulations, regulations and management measures formulated by various ministries and commissions. At the same time, many local food safety management measures have been issued, which has laid a legal foundation for the supervision of food quality and safety in China. After long-term efforts, China has formed a series of laws based on the food hygiene law of the people's Republic of China, the proct quality law of the people's Republic of China, the standardization law of the people's Republic of China, the agricultural law of the people's Republic of China, the measures for the supervision and administration of the quality and safety of food proction and processing enterprises, the provisions on food labeling, the It is a food safety regulation system with the regulation of food additives management and a large number of technical standards related to food safety requirements as the main body, supplemented by the provincial and local government regulations on food safety

At the end of 2007, the Legislative Affairs Office of the State Council, together with relevant departments, made further amendments to the revised draft of the food hygiene law, and changed the name of the revised draft of the food hygiene law to the draft of the food safety law according to the contents of the amendments. On June 1, 2009, the food safety law was officially promulgated. Compared with the previous policies and regulations, the new food safety law has the following highlights

The article 60 of the new law stipulates that food safety supervision and administration departments shall not implement inspection exemption for food. The quality supervision, instry and commerce administration and food and drug administration departments at or above the county level shall conct regular or irregular sampling inspection on food. No inspection fee and any other fees will be charged

According to Article 55 of the food safety law, social organizations or other organizations or indivials who recommend food to consumers in false advertisements, thus damaging the legitimate rights and interests of consumers, shall bear joint and several liability with food procers and operators

The proction and application of food additives should not be regulated by articles 43 to 48 of the new law for those out of the list of food additives. Food additives should be technically necessary and proved to be safe and reliable through risk assessment; Chemical substances other than food additives and other substances that may endanger human health shall not be used in food proction

4. Consumers can claim 10 times of compensation

Article 96 of the food safety law stipulates that those who violate the provisions of this Law and cause personal, property or other damage shall be liable for compensation according to law. In the proction of food that does not meet the food safety standards or in the sale of food that does not meet the food safety standards, in addition to claiming compensation for losses, consumers can also claim compensation 10 times of the price from procers or sellers

Unified national standards for food safety Chapter 3 of the food safety law of the people's Republic of China contains nine articles, which define the principles of unified formulation of national standards for food safety. The health administrative department of the State Council is required to integrate the current quality and safety standards of edible agricultural procts, food hygiene standards and food quality standards, and publish them as national food safety standards
